THESE TERMS AND CONDITIONS DESCRIBE YOUR RIGHTS AND RESPONSIBILITIES WHEN USING A CITIZENS AGAINST RACETRACK EXPANSION WEBSITE. PLEASE READ THEM CAREFULLY.

About CARE and SignThePetition.org

Citizens Against Racetrack Expansion (“CARE”) is a nonprofit organization whose mission is to advocate for preserving the Nashville Fairgrounds, including the fairgrounds’ history of green space.

SignThePetition.org is a project to help carry out CARE’s mission.

Acceptance of Terms and Conditions

SignThePetition.org is provided by CARE. Your use of this website is subject to your compliance with the terms and conditions set forth in this Terms and Conditions agreement (“Terms and Conditions”).

Although you can access and read portions of SignThePetition.org just by visiting the site, you must sign up to join our mailing list in order to receive newsletters. Use of other CARE-affiliated websites is governed by the terms of use policies posted on those sites.

Please note that we reserve the right to update or modify the Terms and Conditions without advance notice by posting a revised Terms and Conditions to this website. By using SignThePetition.org, you agree to be bound by the version of the Terms and Conditions then in effect. If at any point you no longer agree to the Terms and Conditions, please discontinue your use of SignThePetition.org. CARE may deny service to you at any time, including in the event you do not adhere to the Terms and Conditions.

Text Messages

You agree to receive recurring automated texts (e.g., SMS and MMS) messages from CARE, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. All the different types of messages you may receive (i.e. informational messages, recurring marketing messages, fundraising, donations may be solicited, on-demand reply to messages, etc.) shall be known collectively as the “Programs.” Consent to receive automated marketing text messages is not a condition of any purchase.

Msg and Data rates may apply. Please consult with your carrier for rate information.

Message Frequency

Message frequency will vary. We reserve the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. We also reserve the right to change the phone number from which messages are sent. Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. Our service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

Cancellation

If you do not wish to continue participating in any Program or no longer agree to these Terms, you agree to text the applicable Short Code (or regular long code phone number where applicable) or directly reply to any mobile message received from a Program with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT in order to opt out of that Program at any time. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only reasonable and exclusive methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words or phrases other than those set forth above or verbally requesting to be removed from our list, is not a reasonable means of opting out. You may be subscribed to multiple Programs across different Short Codes or regular long code phone numbers, and therefore you must separately text or reply STOP to each Short Code or long code phone number from which you wish to unsubscribe.

Support

For support regarding the Program, text “HELP” to the applicable Program’s Short Code or long code or email us at info@restoreourfairgrounds.org. Please note that the use of this email address, or texting “HELP” to the Program’s Short or long Code is not an acceptable method of opting out of the program. Opt-outs must be submitted in accordance with the procedures set forth above. Our Disclaimer of Warranty The Programs are offered on an “as-is” basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with any Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator, and is outside of our control. We are not liable for delayed or undelivered mobile messages.

Privacy Policy

We respect your privacy. We will only use information you provide to transmit your mobile messages and respond to you, if necessary. This includes sharing information with our program partners, message content providers, phone companies, and vendors who assist us in the delivery of mobile messages. EXCEPT AS SET FORTH IN THIS SECTION, WE DO NOT SELL, RENT, LOAN, TRADE, LEASE OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH PROGRAMS TO ANY THIRD PARTY. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with a Program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If in our sole discretion, we believe that any such information is untrue, inaccurate, or incomplete, or you have opted into a Program for an ulterior purpose, we may refuse you access to the Program and pursue any appropriate legal remedies.

This Privacy Policy and Terms and Conditions is strictly limited to these texting Programs and has no effect on any other privacy policy(ies) that may govern the relationship between you and us in other contexts. Proprietary Rights and Reuse Policy You acknowledge and agree that the information and materials presented on or through SignThePetition.org will remain the property of CARE and its licensors or providers and are protected by copyright, trademark, patent, and/or other proprietary rights and related laws, rules, and regulations. The materials produced by or for CARE (including documents, graphics, and embedded software) are protected by copyright as a collective work or compilation under the copyright laws of the United States and other countries. All individual articles, content, and other elements comprising this compilation and produced by or for CARE are also copyrighted works. You agree to abide by all additional copyright notices or restrictions contained in any materials produced by or for CARE.

Any trademarks, service marks, logos, and trade names displayed on SignThePetition.org (collectively the “Marks”) are the registered and unregistered trademarks of CARE, licensors and suppliers, and others. All Marks on SignThePetition.org not owned by CARE are the property of their respective owners. The Marks owned by CARE, whether registered or unregistered, may not be used in connection with any product or service that is not CARE’s.

Claims of Copyright Infringement

SignThePetition.org is controlled and operated by CARE from its principal office in the state of Tennessee, United States of America, and CARE is not subject to the laws or jurisdiction of any other state, country, or territory. Those who choose to access SignThePetition.org do so on their own initiative and at their own risk and are solely responsible for complying with all local laws, rules, and regulations.

Termination

You agree that CARE, in its sole discretion, may terminate your use of SignThePetition.org or any part thereof, at any time and for any reason, including if CARE believes that you have violated or acted inconsistently with the spirit of the Terms and Conditions. Further, you agree that CARE will not be liable to

you or any third party for any termination of your access to SignThePetition.org.

You agree to submit to the exclusive jurisdiction of any court located in the jurisdiction of the state of Tennessee, United States of America, and waive any jurisdictional, venue, or inconvenient forum objections to such courts in any matter arising out of or related to SignThePetition.org or these Terms and Conditions. If any provision of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and Conditions and will not affect the validity and enforceability of any remaining provisions. CARE may assign its rights and obligations under these Terms and Conditions.
